Not sure you quite understand the RLA correctly. Company's don't "choose" to follow the RLA to get away from paying OT. RLA has zero to do with paying OT. The RLA applies to every air carrier certificate holder. What it does is preempts strikes and work disruptions, and gives labor the right to bargain for their labor rules and benefits. The Airline Deregulation Act preempts State and Local government from imposing OT rules since labor has the right under the RLA to organize and bargain.
An airline is always subject to the RLA, as are the employees. Without a union, the company makes the workrules as it wishes. Employees cannot strike until the NMB releases them to do so, regardless of union status. |
