Powered-Lift... Not Vertical Lift....

There has always been a Powered-Lift category. This NPRM appears to just apply it to commercial operations. So, it appears they are trying to get stuff more in line so that more companies can start using tilt-rotor for their operations. 

What are you trying to get at?
