OPEIU gets to keep the cash?

A union having so much cash that it offers a self-funded life insurance policy is collection too much money from it's members! 

But, suppose nobody is listed....   who do they pay if, god forbid, the inevidable?

Are they licensed in each State to be an insurance provider (where laws for insurance apply)?
