I also previously won air 21 case against an EMS providor over being terminated for refusing to fly an aircraft that had sustained damage. The operator was refusing to allow it to be documented in the discrepancy log, and be properly cleared by maintenance. After I won my case, I refused the reinstatement. But I received my lost wages and in my case the FAA did take certificate action against the company for having already flown 3 legs, 2 with the Chief Pilot's approval and 1 with a patient on board. Could of easily been avoided had the company just did the right thing. That company went on to kill a few people in a pretty short span and they no longer operate helicopters. Another way to avoid it would of not hired a complete moron who had not flown in many years, and still thought he was behind enemy lines and his completion of the flight my potentially result in an air medal. He was the one that damaged the aircraft, and then proceeded to fly it.
