USUALLY it is "Invoked as a secondary infraction. It is only associated with another specified infraction."  but it depends on the FSDO, Inspector, Supervisor, Manager, Regional Leagal Beagle, and so on.  Might not hold up as far as a NTSB trial, but most cave before that.
