On what type of work you're doing. Plenty of Powerline work does just that Although some requires a congested area plan.

you were careless and reckless for hovering 100 feet over houses as you would be considered a "hazard to persons or property on the surface". they would be right and you would have to prove you weren't, which would be difficult.

somebody says you can do something really stupid and dangerous and then argue that it's legal because the constitution doesn't expressly forbid it. 

"nothing in the costitution or the FAR's says anything about me not hovering over the tops of houses so I'm good!"

91.905 list regs that can be waivered by the FSDO at any time.   

I applied for the FAR 91.119 waiver to land my R44 in my backyard in a residential neighborhood and was approved.
