Unless things have changed since 2018, the FAA claims no oversight of "Public" aircraft. Flying a state owned and operated helicopter without a license might not be illegal.

You're right the FAA has no oversight but........ They are still operated in accordance with the federal aviation regulations when in public airspace.   If a public use aircraft performs a maneuver or does an air space violation in the public airspace the pilots can still be held liable and if they do hold a FAA certificate it can be revoked or they can be prevented from having a certificate in the future for a specified amount of time...    It happens quite frequently with military aircraft operating in public airspace they receive a pilot deviation and are prevented from receiving a civilian pilot certificate for a specified amount of time.   

Name one time a military pilot was discount the FAA.  Military ops have complete immunity from civil regs. A military pilot may well be disciplined by the military but never the FAA.  I broke many FAA refs in US airspace while serving never had a issue with the FAA. by the way all devia were done because of the specific mission never just goofing around

Well you couldn't be more wrong I can tell you about an F-18 pilot that had his civilian certificates  revoked when he  screwed up in the F 18 and the FAA took away his civilian certificates for five years.  He turned left when he should've turned right and caused a airliner to deviate from course.   They did not use just compliance action or an EIR report to the military liaison they revoke his civilian certificates for five years.

As an FAA ASI-OPS (We moniter fourums all the time) I can tell you we get more Pilot deviations from military pilots than anybody else when operating in the NAS.   Yes we have no control over military pilots when they're on their military base or in an MOA but when they are in the NAS they can be violated just like anybody else.   The process is a little different where we go through a military liaison but if they have civilian certificates they can be revoked or we can prevent them from getting civilian certificates for a number of years after they get out of the military.   Happens all the time my horse.

Happens all the time Pilot does not follow ATC instruction which causes a Bracher report then generates a pilot deviation then  generates an EIR which becomes legal action.

I do hope that artical is just media abstraction. AC-00-1.1B mostly addresses civil operators with government contracts which came about when certain CIVIL Blackhawk operators got fire contracts to be flown by CIVIL pilots but still transport fire fighters.

 An aviation attorney with 30 years in would know that. To date there are lots of surplus military aircraft in the hands of civilian law enforcement. I once flew them. Those agencies can operate those aircraft without FAA rated pilots or anything resembling normal 135 certification. Including every federal 3 and 4 letter agencies.

Yes, we all know about the surplus aircraft but that would involve aircraft certification, not pilot certification. I don't think there is a law enforcement or government entity out there flying without rated pilots. What the hell does civilian pilots flying a blackhawk have to do with anything? Were they rated pilots? The liability exposure would keep this from happening. Yes, the can be sued for negligence. Do you have any idea what the word abstraction means? Anybody can fly a helicopter you see it all the time in the movies or on television But I do think you have to the hero to qualify.
