Where it becomes a real problem is when they get paid per diem when they shouldn't, like whne they bill M&IE to their room but collect the per diem also.   Of course, it takes an auditor (someone who knows the trick and is looking for it) to uncover the fraud/corruption occuring under their noses.

And did the union report their per diem as income to the IRS?  (Which was the issue, not the diversion tangent you attempted)

 

Per Diem rates $59/day are considered income, not reimbursements and need to be taxed.  That's why the companies keep it at the standard rate or below, including airlines.  Airlines paying per diem to pilots flying out-in schedules get taxed because it doesn't involved an overnight.

IRS Publication 463 (Chapter 6):

Allowance more than the federal rate. If your allowance is more than the federal rate, your employer must include the allowance amount up to the federal rate under code L in box 12 of your Form W-2. This amount isn’t taxable. However, the excess allowance will be included in box 1 of your Form W-2. You must report this part of your allowance as if it were wage income.

...   if they want to claim they are a real union!   Real union's do not attempt to subordinate classes under other classes of equal status.   It isn't democratic at all!
