   For all you Part 135 operators out there that do business in our State all year long and then try to base your aircraft out of state the last week of the year, that is called Tax Fraud.

    The Louisiana Department of Revenue ( LDR ) is now aware of the scheme and will now do unannoced inspections and random dates to ensure compliance with all Tax Laws.

do it. It's probably like a yacht registration in that there is a specific amount of time it must be in the state to require registration. That's why mega yachts go offshore every 59 days. They would have to register at 60 and it will be big bucks. If it's not defined (I'm guessing it's not) too bad. If it is, I'm sure they are well aware of it but thanks for the scary warning.

Always thought it looked like a shady practice. Remember one year the fog rolled in early and we were all waiting for any kind of break in the weather to get out of dodge.

They are fully advised by tax attorneys and are more tax compliant than you think you are. If somehow there were a bigger tax burden as you insinuate there should be, it will just get passed on to the customer and gas prices, or taken in the shorts in the form of wages. Thanks for nothing.

While you may call it fraud. If the practice is legal then I’m all for it. I have few deductions left am tired of being taxed to about 50% of my earnings ( all local, fed, sale, property, fuel taxes inclusive)

What does my money buy? Apparently damn little that makes MY life better.

If the LDR can’t or won’t change that law then why would any company not take advantage?

State income tax, federal income tax, soc security tax, medicare tax, property tax, retail sales tax, fees that you are charged that don't get voted on are essentially a tax, add that all up in Louisiana, that's roughly 55%. half of what we earn gets stolen from us in the form of some benifit to a politician or govt official, or entity. WHAT A DEAL.

Nobody is paying 50%, it's more like 55-56%. What is there to show for it? Crappiest roads, corrupt expensive government, bad schools with underpaid teachers pushing tranny and wokism, too many colleges around every corner selling worthless degrees and advanced indoctrination, and so on and so forth. There is basically nothing our tax money goes toward that a resonable person would approve of except the poor souls in uniform willing to keep us safe for what little they are paid. 

The day will come when all will have to give account for their deeds. What people have done to others in mass for their own puny benifit, will not be looked upon in favor. No deception will hide those sins.

I think this is the real question, is moving aircraft out of the state on the last day of the year to avoid taxes a legal practice or just taking advantage of a loophole in the tax code? Guess we will find out in the near future.

It's totally within the law to do this,,,,,if the State would change the tax code from taxing the value of an aircraft where it sits on Jan 1 to a landing/takeoff tax this would be a lot more fair,,,,you pay for what you use.

Politicians would never stop increasing those kinds of taxes until they kill off aviation in the state. The government(s) in Louisiana are corrupt and self-serving first, political party loyal second, constituant last. If you think giving them any more would fix anything, just look at the money black hole of New Orleans. it is said the new airport will be condemned in 5 years because of horrible concrete jobs and its hollow under the foundation and sinking. Old airport is just fine, and is actually bigger. I-10 has been under construction with grant money since the 90's, and seems to never be done. Contractors get rich, and people get taxed. You can also google this one: why Walt Disney went to Florida instad of the North Shore where it was originally planned. 

There is just not going to be any fairness in which money is stolen from the people by this state. So, If a company is resourceful enough to beat these crooks at their own game, more power to them.

Between tax fraud and tax avoidance. It is up to the retards in the Louisiana legislature to change and write the laws. If they were concerned they would change the laws. This practice has been going on for decades, and you can bet that all of these companies have attorneys and accountants advising them. Write your state senator or congressman if you really think this is a big deal.

It says there's an annual 4% tax on commercial aircraft. The aircraft are to be taxed "where situated" on January 1st. So if they happen to be in TX or MS on January 1, oh well. Never worked for an operator that did this but it sounds like something Westwind would try, at least for a spare.
