What are the differences in Part 91 flight time and crew rest limitations between helicopters and fixed wing? Does Sec. 91.1059 also apply to helicopter operations? According to 91.1059 minimum rest before duty is 10h, my employer a helicopter company operating under Part 91 allows us only 8h of rest between 16h duty days. Is that even legal?

Part 91 abuses crew rest across the country...tours, utility etc.

The standard should be 10 hrs...but who says it make sense?

Chances are, your helicopter company is not operating under fractional ownership. So Subpart K does not apply. If you are tired and burnt out, tell your supervisor, more than likely they will step up and allow you some time to recover. 

Its the ones that sit all day for 8 hours of a 10 hour duty day and then say they are too tired from sleeping all day to take a flight that ruin it for everyone.

"more than likely" the company that works pilots 16 hour duty days would be most receptive to "stepping up" and letting you get some rest.

especially if done repetitively. no doubt you fly a 44 doing tours but if you won't do it, some other schmuck will. sounds like a terrible operator.

I once logged Just over 12 hours of flight time in a single day part 91. 

the owner also had many commercial trucks and drivers.  After that particular day I insisted on having the same operating DOT limits as his truck drivers.   

he ended up being ok with that.

carefully at what may be considered Careless and Reckless.  Look in to cases involving it.  If you think your behavior runs in to it I suggest fixing it or moving on.  Pure Part 91 can get you in to trouble but usually only post incident or accident as the FAA does little oversight in that area.

USUALLY it is "Invoked as a secondary infraction. It is only associated with another specified infraction."  but it depends on the FSDO, Inspector, Supervisor, Manager, Regional Leagal Beagle, and so on.  Might not hold up as far as a NTSB trial, but most cave before that.

such as an incident or accident, and don't ever say never.  FARs are guidelines and can be legally interpreted in association with other substantive supporting law that may support specific interpretations to fit any relevant situation.  Sounds like going out of bounds but it definitely is not.
