I recently recieved a 90% disability rating from the VA due to mostly minor issues that all added up. My question is does my AME have or need this info or can it wait the 6 months til my next physical? |

I wouldn't worry about it, just state your disabilities on the medexpress form. Non of my AME's have ever even brought up my VA disabilities.
BUTTTTTT
IF you are getting disabilty for something related to mental health or sleep problems, then you're royally screwed since the VA shares medical info with the FAA. I guess because our privacy and HIPA doesn't apply to big brother.

There are numerous problems/conditions that will end your career as a military aviator but that don't apply to civilian aviation. Fit for flying in a war is totally different than fit to fly. |

as it applies to improper sharing of medical info. I don't see medical info sharing between providers as improper under the interpretation of the HIPAA law. If you know you have a disqualifying condition, report or stop flying. |

Sleep apnea waiver was/is pretty easy to get, as long as you are using your machine and have the logs to prove it. I have never had an issue. |

The simple answer is no. You can receive both VA Disability Compensation and SS, but only the VA Disability Compensation is tax free. The complicated answer about taxes on your SS (to include Social Security Disability Insurance - SSDI) is "it depends." If you file as single, 50% of your SS or SSDI is taxed as income if the total of all your earned and unearned income (excluding VA Disability Compensation - which is tax free) is between $25K and $34K. If that total is more than $34K, 85% of your SS or SSDI is taxed as income.
If you're "Married and Filing Jointly," those numbers increase to $32K to $44K for the 50% taxed as income, and anything over $44K gets 85% of your SS/SSDI taxed as income.
BTW, it's not a sliding scale. $1.00 over the limit gets you to 85% every time! |

your AME and be ultra careful because the FAA is in the information pipeline since both are Fed entities. Not reporting is a good way to lose your certificate, and livelihood. Be careful. |

If you take a FAA Job your Military and VA medical records are checked by the Regional FAA Flight Surgeon, but the masses are not so scrutinized. PTSD will be grounding until the FAA is satisfied it is not a problem, usually taking at least eighteen months or more of being grounded. |

Pay for an aeromedical consult with your AME before your physical is due. At least that's what I did and he said there was no problems with any of my VA ratings. Peace of mind was well worth the $100. Don't know if all AMEs work that way, but mine does. |

There was a fatal crash a few years back, fixed wing, where the NTSB found out the pilots were receiving compensation for grounding conditions without reporting the conditions to the FAA. Now we all have a few extra boxes to check every year. If it's grounding, you're grounded and should have lied about it when you claimed with the VA, not now with the FAA.
Don't they teach about lying to the flight surgeon in military pilot training any more? |

you did the right thing but remember an AME is really none other than a POI when it comes to interpreting legal requirements as only FAA Legal in DC are allowed that.
Doctors tend to think they can do anything they want without reference to Part 67, say time required to be grounded after successful high blood pressure resolution or after one is considered to be healed from a hip replacement.
AMEs can NOT change those requirements, so, they can NOT clear a pilot to return to work until the wait periods are over. They must reference those requirements. Do yourself a favor and look up whatever is required per FAA before you have to deal with an AMEs schrew up. In any case if one is released too soon just call the FAA Aeromedical Branch to make sure all is well.
Seen both the above messed up with a nasty response from Oak City though in both cases the pilots were not negatively impacted, not sure what FAA said to the doctors.
AOPA is a great resource in such cases though helicopter pilots tend not to think that organization has much to do with our helicopter crowd, which is totally incorrect. Gotta be a member, but very much worth it. |

I've got to agree with "AOPA is a great resource in such cases." Join AOPA and pay for their Medical and their Legal services. It's less $200 a year for their best package, and could very well come in very handy. I'm a member and had them help me with two different medical issues over the years. I'm still flying and those medical conditions still exist. Also know a guy who, unfortunately, got a DUI. Their legal service protected his rights and he is still flying too! |

A certificate holder has privileges until those are in question which then is sorted IAW legal rights.
I actually applaud your thinking about specifics though - very much required when you get in to legal stuff.
First rule? Keep ur mouth closed until legally compelled to open it. Gives time to figure the opposition and response.
