Commercial flying is added to totals limited by 135.263, not 135.267.
Commercial flying is not factored into REST requirements. REST requirements are on a 24 hour look-back needing 10 hours of REST. DUTY is not REST, so you cannot count DUTY as satisfying the REST lookback.
Nothing at all to do with "Commercial flying". They are looking for DUTY.
Where do you come up with this made up stuff? |

You are limited to 8 hours single pilot during a 14 hour duty day. Your plan allows a pilot to continue past 14 hours, until he exceeds 8 hours by less than 30 minutes, more than 30 minutes, and more than an hour, which clearly cannot be the intent of the regulation. |

Fly the company aircraft on a multi leg cross country, at the direction of the company, to swap out that aircraft with another, or any other reason, as long as there is no passenger or other crew on board. You would also be subject to all company policies, GOM, fuel samples, flight releases etc. Such restraint could in no way be considered rest, therefore must be considered duty time, but ignored in your no rest plan. |

Not even FAR 135.267(c). Because, even there, if the certificate holder doesn't maintain regularly assigned duty periods of 14 hours or less, it REVERTS to FAR 135.267(d) [10 hour rest in 24 hr lookback]
It is not about DUTY LIMITATION, it is about REST REQUIREMENTS.
I can get off DUTY, get 8 hours of good REST (or less even), come back to work and be on DUTY another 10, 12, 14, whatever flying. Just can't fly Part 135!

Off duty with no restraint. Rest must be a continuous 10 hours to qualify as proper rest. The 14 hour duty day IS a requirement in which no more than 8 hours of all commercial single pilot flying must take place. Under your plan, you can put in a 14 hour duty day, then continue commercial flying indefinitely as long as it's part 91. It would have to be free from all restraint as well, to qualify as not duty in excess of 14 hours. |

They care that when you Finally do get off of duty, that you get the required uninterrupted rest of 10 hours looking back in the last 24 before you again pilot an aircraft for Part 135 operations!
They absolutely don't care that you are still on duty, they are not the Department Of Labor or union CBA arbiters |

You are Limited as single pilot to 8 hours of flying in a 14 hour charter(part 135) duty day. That includes all commercial flying. Any flying for the company who is paying you must cease after 8 hours of flying.
Repositioning in this case would certainly be a violation. Plenty of pilots have been fired for it, and violated for it.
Neither can your company legally direct you to fly longer, even if it is without patients or med crew. |

There is no limitation to commercial flight time or duty time under Part 91
There is a limit to 8 hours of flight time for a pilot of Part 135 operations, and that pilot must include all commercial flying in those totals when applying it to Part 135, but not to Part 91 operations.
You can exceed the 8 hour limitation in Part 135 if the certificate holder schedules you in regularly assigned duty periods of no more than 14 hours under 135.267(c), but if you can't follow 135.267(c), you simply re ert to 135.267(d) 24 hour look-back and 8 hour flight time limitation (for anyb135 flying)
You are not limited to 14 hours of duty or 8 hours of flight time simply because you are a "commercial pilot". That is made up nonsense! |
