The requirement is based on arbitrary criteria clearly making it discrimination. the fact there are two classes of pilot's currently authorized under the union's contract (before cba , after cba) makes it not an age criteria based on safety, but on an arbitrary basis. Hence, clearly age discrimination!

and since there isn't any FAA restrictions on age, the arbitrary requirement has no sensible foundation.
