Because there are two parties with a conflict that must be resolved.  Most times, the likely outcome is known which is why the vast majority of cases settle.  Sometimes, people have to be forced to do what they are supposed to do.

When the outcomes not reasonably known, and the would be losing party cannot accept reality, sometimes, it must go before a judge or jury to be decided.
