The owner of the company employed and trained the pilot and therefore carries most of the responsibilty. If it is pilot error, the company will be sued for being negligent for hiring and retaining the pilot and not training him properly. If you think pilot error relieves a company of responsibility, you are stupid and naive. The pilot's estate most likely will have realtively few assets. Why sue somebody if you won't get anything out of it. FFS!
